Warranty
About Warranty
1. Introduction
This Warranty Policy explains how warranties work on kobikoba.com (“Kobikoba,” “we,” “us,” or “the Platform”).
Kobikoba is an online marketplace that connects Buyers directly with independent shop owners and product sellers (“Sellers”). We do not manufacture, sell, import, stock, ship, or service any products ourselves.
The key thing to understand: All product warranties are provided, administered, and honored exclusively by the individual Sellers — not by Kobikoba. This policy explains how warranties work between you and Sellers, and what role (if any) we play.
2. Our Position on Warranties
2.1 Kobikoba Provides No Warranties
Except as required by law, Kobikoba makes no warranties of any kind regarding any product listed, sold, or advertised on the Platform, whether express or implied, including but not limited to:
- Warranties of merchantability;
- Warranties of fitness for a particular purpose;
- Warranties of quality, durability, or performance;
- Warranties that a product will match its listing, description, or photographs;
- Warranties of title or non-infringement.
All products on the Platform are sold “as described by the Seller” and, to the extent permitted by law, “as is.”
2.2 Sellers Are Solely Responsible
Each Seller is solely and exclusively responsible for:
- Determining whether their products carry any warranty;
- Defining the scope, duration, and terms of any warranty they offer;
- Communicating warranty terms clearly to Buyers before purchase;
- Honoring warranty claims in accordance with their stated terms;
- Complying with all applicable warranty, consumer protection, and product liability laws in their jurisdiction and yours.
3. How Warranties Work on Kobikoba
3.1 Seller-Defined Warranties
Every Seller sets their own warranty terms. Common types include:
Table
| Warranty Type | What It Means |
|---|---|
| No warranty / as-is | Seller offers no warranty beyond any mandatory legal rights |
| Limited warranty | Covers specific defects for a specific period (e.g., 6 or 12 months) |
| Manufacturer warranty | Product is covered by the original manufacturer’s warranty |
| Extended warranty | Optional additional coverage, sometimes at extra cost |
Always review the warranty terms stated in the product listing or Seller’s store policy before purchasing. If warranty terms are not stated, ask the Seller directly before buying.
3.2 Statutory Rights Are Not Affected
This policy does not limit, exclude, or replace any non-excludable statutory consumer rights you may have under the laws of your country or region — for example:
- European Union/EEA & UK: Under the EU Consumer Rights Directive and national laws, consumers typically have a 2-year legal guarantee of conformity (1 year in some countries for second-hand goods) against the Seller. This legal guarantee exists regardless of any commercial warranty the Seller offers.
- Other jurisdictions: Similar mandatory consumer guarantees may apply under local law.
Any attempt by a Seller to exclude mandatory statutory rights may be legally void. Your statutory rights are against the Seller, not against Kobikoba.
3.3 Warranty vs. Return Policy — Know the Difference
- A return policy governs whether you can send a product back within a set period (e.g., 14 or 30 days), usually regardless of fault;
- A warranty covers defects, malfunctions, or failures that appear after purchase, for a defined period.
Both are set and administered by the Seller. If you’re unsure which applies to your situation, ask the Seller directly.
4. How to Make a Warranty Claim
4.1 Step 1 — Contact the Seller Directly
All warranty claims are filed with the Seller, not with Kobikoba. To claim a warranty:
- Find the Seller’s contact details in your order confirmation or their store page;
- Provide your proof of purchase (receipt or order confirmation issued by the Seller);
- Describe the defect clearly, and provide photos or video if possible;
- State the remedy you’re seeking (repair, replacement, or refund), referencing the Seller’s stated warranty terms.
4.2 Step 2 — Cooperate with the Seller’s Process
The Seller will determine, according to their own warranty terms and applicable law, whether the claim is valid and what remedy applies. Remedies may include repair, replacement, refund, or partial refund, as determined by the Seller’s terms and applicable legal requirements.
4.3 Step 3 — Escalate to Kobikoba if the Seller Fails You
If the Seller:
- Refuses to honor a warranty they explicitly offered;
- Does not respond within a reasonable time;
- Treats you unfairly or engages in deceptive practices;
you may submit a complaint to Kobikoba via our [Report a Problem / Complaint Form] or by emailing [complaints@kobikoba.com]. See Section 6 below for what we can and cannot do.
5. What Is Typically Not Covered by Warranties
Unless the Seller states otherwise, most warranties do not cover:
- Normal wear and tear from regular use;
- Damage caused by misuse, abuse, accidents, neglect, or improper handling;
- Unauthorized repairs, modifications, or tampering;
- Damage caused by failure to follow the product’s instructions;
- Consumables or parts designed to wear out (batteries, filters, blades, etc.);
- Cosmetic damage that does not affect functionality;
- Products purchased second-hand, unless otherwise stated;
- Loss of data, time, income, or other consequential damages.
Always check the specific Seller’s warranty terms for the exact exclusions that apply.
6. Kobikoba’s Role in Warranty Disputes
6.1 What We Can Do
While we cannot adjudicate warranty claims or force a Seller to provide a remedy, we take platform integrity seriously. When you report a warranty dispute, we may:
- Review the Seller’s listing and stated warranty terms;
- Review the Seller’s history, including other complaints;
- Contact the Seller and request an explanation;
- Take enforcement action against Sellers who repeatedly or egregiously violate their own stated policies, up to and including:
- Formal warnings;
- Listing removal;
- Temporary account suspension;
- Permanent removal from Kobikoba;
- Report suspected illegal activity (e.g., sale of counterfeit or dangerous goods) to relevant authorities where required by law.
6.2 What We Cannot Do
We cannot:
- Force a Seller to repair, replace, or refund a product;
- Act as an arbitrator, mediator, court, or ombudsman;
- Issue refunds or remedies ourselves (we never hold your payment);
- Guarantee any outcome of your dispute with a Seller.
Your legal recourse for warranty claims lies against the Seller. Depending on your jurisdiction, you may also have options through:
- Your payment provider (chargeback or payment dispute);
- Consumer protection agencies in your country;
- Small claims court or other legal remedies.
7. Reporting a Seller for Warranty Issues
To report a warranty problem, provide:
- Your username and the Seller’s store name;
- The product and order date;
- A description of the issue and the warranty term that applies;
- Evidence: screenshots of the Seller’s warranty terms, correspondence with the Seller, photos/videos of the defect;
- The remedy the Seller offered or refused.
Submit via: [Report Form link] or email [complaints@kobikoba.com]. We aim to acknowledge complaints within [3–5] business days.
8. Seller Warranty Obligations
All Sellers on Kobikoba agree to:
- State their warranty terms clearly and truthfully in their listings or store policies;
- Not falsely advertise warranty coverage they do not intend to honor;
- Honor their stated warranty terms and all applicable mandatory consumer laws;
- Respond to warranty claims within a reasonable timeframe;
- Not misrepresent products, conditions, or coverage.
Sellers who violate these obligations risk enforcement action under our [Terms of Service], including removal from the Platform.
9. Changes to This Policy
We may update this Warranty Policy from time to time. Changes take effect upon posting to this page with a revised “Last updated” date. For significant changes, we will provide notice on the Platform. Your continued use of Kobikoba after changes take effect constitutes acceptance of the updated policy.
